Dear City of Tualatin,
A review of project documents reveals that Mackenzie/Lam did not notify any CIO representatives prior to the June 2024 neighborhood developer meeting, as required by Tualatin Development Code 32.120.5 (b)(iii). The code requires an applicant to send notice to CIO representatives via First Class Mail at least 14 days *before* the neighborhood developer meeting. This requirement was not met at the time, nor can it be met retroactively.
Lam and Mackenzie have been through the Tualatin land use review process before and they know the requirements. In 2022, Suzannah Stanley, Mackenzie Planner, demonstrated that she is very familiar with the CIO notification section. On pages 29-32 of Lam's IMP 22-0001 application, Ms. Stanley is on the record arguing that this notice requirement does not apply to Lam:
"We did not contact any City-recognized CIOs.
Please use this statement in your completeness checklist.”

If the City of Tualatin allows Mackenzie and Lam to repeatedly and flagrantly violate notice requirements, the legitimacy of the CIO program will be compromised.
At the June neighborhood developer meeting, Mackenzie said that “the project team is open to continue discussing topics of concern with neighbors” (see meeting minutes #13) however, repeated attempts by the community to open a dialogue with Lam and Mackenzie have been met with refusal and stonewalling. Lam’s Chief Communication Officer, Steve Fine, clarified their position in his November 2024 email:
"We are committed to following the City’s process to finalize a plan for our project that works for the City, the community, and Lam. In keeping with this approach, please address future communications about traffic considerations to the City of Tualatin.”
Because Mackenzie and Lam have not followed proper notice procedure, we hereby ask the City of Tualatin to deny Lam’s current land use application so that the applicant can reset and start over.
